This covers the General Terms and Conditions (GTC) and the full Privacy Policy for all services provided by alphalist GmbH (hereinafter "the Organizer"), including the website www.alphalist.com, the alphalist Slack community, the alphalist Podcast, and all hosted events.

1. Who We Are & General Provisions

1.1 Data Controller: The responsible controller for the processing of your data under data protection laws is alphalist GmbH, Geranienweg 4, 24610 Trappenkamp, Germany. Email: [email protected].

1.2 Scope: alphalist is an exclusive network for CTOs. By applying for membership, using our Slack workspace, or purchasing an event ticket, you agree to these terms and the processing of your data as described herein.

2. Full Privacy Policy (GDPR Compliance)

2.1 Data We Collect

  • Membership & Application Data: Name, email address, LinkedIn profile, current job title (e.g., CTO), company name, and technical interests. This is used for our "vetting" process.
  • Community Data: Information shared within our closed platforms (e.g., Slack), including posts, profile details, and direct interactions.
  • Event Data: Registration details, attendance logs, and, where applicable, dietary requirements.
  • Usage Data: IP address, browser type, and interaction logs via cookies to optimize our platform.

2.2 Purpose of Processing

  • Community Management: To verify eligibility and provide access to exclusive platforms.
  • Networking: To facilitate connections between technical leaders (e.g., visibility in "The List").
  • Communication: Sending updates, event invitations, and newsletters related to the alphalist ecosystem.

2.3 Legal Basis for Processing

  • Consent (Art. 6(1)(a) GDPR): For newsletters or non-essential cookies.
  • Contractual Necessity (Art. 6(1)(b) GDPR): To fulfill membership services.
  • Legitimate Interest (Art. 6(1)(f) GDPR): To ensure platform security and maintain a high-quality professional network.

2.4 Data Sharing and Third Parties

We do not sell your personal data. Sharing only occurs:

  • Within the Community: Your professional profile is visible to other verified members to enable networking.
  • Service Providers: We use trusted tools such as Slack (communication), hosting providers, and email marketing services. These providers are strictly bound by our instructions.
  • Event Partners: For sponsored events, attendee lists may be shared with partners if you have been informed beforehand or provided consent.

2.5 Your Rights

Under the GDPR, you have the right to access, rectify, or erase your personal data, as well as the right to data portability and the right to object to processing. To exercise these rights, contact [email protected].

3. Returns, Cancellations, and Right of Withdrawal

3.1 No Returns or Exchanges: Purchased tickets for alphalist events are generally excluded from return or exchange. Cancellations by the participant are not permitted, including in cases of illness or non-attendance.

3.2 Cancellation or Rescheduling by the Organizer:

  • Refunds: A return of tickets is only possible in the event of a total cancellation or an unreasonable rescheduling.
  • Force Majeure: The right to a refund does not apply if the cancellation is due to Force Majeure.
  • Content: Announcements regarding speakers or topics are non-binding and subject to change.

3.3 Statutory Right of Withdrawal: Pursuant to Section 312g (2) No. 9 of the German Civil Code (BGB), there is no statutory right of withdrawal for ticket purchases for either businesses or consumers.

4. Limitation of Liability

4.1 General Disclaimer: Participation is at the participant's own risk. The Organizer assumes no liability for damages, including accidents or lost personal items.

4.2 Exceptions: This disclaimer does not apply to damages resulting from intent or gross negligence, or injury to life, limb, or health.

4.3 Negligence: In cases of simple negligence, liability is limited to typically foreseeable damages.

5. Rights of Use (Media & Data)

5.1 Documentation: Participants are aware that film and photography will take place during events.

5.2 Grant of Rights: By registering, participants agree that registration data, photos, film recordings, and interviews may be used for event-related promotional purposes (social media, website) without compensation.

5.3 Revocation: Participants may object to the use of specific close-up imagery by notifying event staff or contacting the Organizer.

6. Final Provisions

6.1 Changes: We reserve the right to update these terms to reflect changes in services or law.

6.2 Governing Law: These terms are governed by the laws of the Federal Republic of Germany.
